1. Acceptance of Terms

By accessing or using FindTamales ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform. We reserve the right to update these terms at any time with notice provided on the Platform.

2. Description of Service

FindTamales is a marketplace platform that connects tamale sellers ("Sellers") with buyers ("Buyers"). The Platform provides listing, discovery, and communication tools but does not itself sell tamales, process payments between users, or guarantee the quality of any products sold through the Platform.

3. User Accounts

You must create an account to use certain features of the Platform. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account.

4. Seller Responsibilities

• Sellers are solely responsible for the quality, safety, and legality of their products.
• Sellers must comply with all applicable food safety, health, and business licensing laws in their jurisdiction.
• Sellers must accurately represent their products, pricing, and availability.
• Sellers must fulfill orders they accept in a timely manner or promptly notify buyers of cancellations.

5. Buyer Responsibilities

• Buyers are responsible for reading product descriptions and contacting sellers with any questions before ordering.
• Buyers must honor orders they place and arrange payment as agreed with sellers.
• Buyers must provide accurate information including pickup or delivery addresses.

6. Prohibited Conduct

You may not use the Platform to:

• Post false, misleading, or fraudulent listings or reviews
• Harass, threaten, or discriminate against other users
• Violate any applicable law or regulation
• Scrape or systematically extract data from the Platform without permission
• Use the Platform for any purpose other than buying or selling tamales

7. Fees and Payments

FindTamales charges no commission on transactions between buyers and sellers. Seller subscription fees (Free, Pro) are billed as described on the Pricing page. All subscription fees are non-refundable except as required by law. We reserve the right to modify fees with 30 days' notice.

8. Disclaimers and Limitation of Liability

The Platform is provided "as is" without warranty of any kind. FindTamales is not liable for the quality, safety, or legality of products sold through the Platform, or for any disputes between buyers and sellers. To the maximum extent permitted by law, FindTamales's total liability for any claim shall not exceed the amount paid by you to FindTamales in the 12 months preceding the claim.

9. Intellectual Property

All content on the Platform, including logos, text, and software, is owned by FindTamales or its licensors. Sellers grant FindTamales a non-exclusive license to display their listing content on the Platform for the purpose of providing the service.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may close your account at any time from your account settings.

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law provisions. Any dispute arising from these Terms shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association.
